[ARCHIVED] Weed Commissioner Notice to All Property Owners



Be it resolved by the Board of Supervisors of Hardin County, Iowa Resolution 2018-19, that pursuant to the provisions of Chapter 317.13 and 317.14 2018 Code of Iowa (PDF), it is hereby ordered:

Each owner and each person responsible for managing lands, shall cut, burn or otherwise control all noxious weeds as defined in this chapter.  Weeds shall be controlled as prescribed in the program of weed control order or orders made by the Board of Supervisors.  The owner and person responsible for managing any lands shall keep said lands free from the growth of any other weeds that make the streets or highways adjoining said land unsafe for public travel.  It is highly recommended that organic, grape, any producer with sensitive crops, or anyone with roadside spraying concerns contact the Hardin County Weed Commissioner’s Office (641-849-0333).

Noxious weeds from the Iowa Code 317 that are present in Hardin County shall be controlled as often as is necessary throughout the growing season. Control is defined as the prevention of the spread of noxious weeds by limiting the production of reproductive structures.

Noxious weeds shall be cut or otherwise destroyed on or before the following dates and as often thereafter as is necessary to prevent seed production:

Group 1. June 1, 2017, for Leafy Spurge, Perennial Pepper Grass; Sour Dock; Smooth Dock, Sheep Sorrel, Tall Thistle and Musk Thistle.

Group 2. June 20, 2017, for Canadian Thistle, Russian Knapweed, Buckthorn, Wild Mustard.

Group 3. July 1, 2017, for Horse Nettle, Perennial Sow Thistle, Quack Grass, Butter Print, Puncture Vine, Cocklebur, Bull Thistle, Marijuana (Hemp), Sunflowers, Wild Carrot and Buckhorn Plantain.

In case of failure to comply in any order of control of weeds, the commissioner, deputies, or agents may, subsequent to the time after service of the notice provided for in Section 317.6, enter upon the land and control the weeds or impose a maximum penalty of $10 per day, up to ten days, that the owner or person responsible for managing the land fails to comply.  If a penalty is imposed and the owner or person responsible for managing the land fails to comply, the commissioner shall cause the weeds to be controlled.  If the commissioner, deputies, or the agents enter the land and control the weeds, the actual cost and expense of cutting, burning, or otherwise controlling the weeds, along with the cost of serving notice and special meetings or proceedings, shall be paid by the county and together with the additional assessment to apply toward costs of supervision and administration, be recovered by an assessment against the tract of real estate on which the weeds were growing as provided in Section 317.21.  Any fine imposed shall be recovered by a similar assessment.

The Hardin County Integrated Roadside Vegetation Management program shall control noxious weed infestations and other problem vegetation in county road rights-of-way which may threaten public health, cause economic loss or effect safe travel. Costs to control noxious weed problems associated with physical changes in the right-of-way, (i.e. over spray, excess tillage, untimely mowing). Soil erosion by wind and water promotes annual and perennial weed growth on agricultural land and in road rights-of-way.  Landowners and operators are encouraged to be good land stewards and utilize erosion control methods such as conservation tillage, field borders, buffer strips, and grassed waterways.
